PESHAWAR: Mayor Mardan Himayat Ullah Mayar has challenged amendments in Local Government Act 2013 passed by Khyber Pakhtunkhwa Assembly before Peshawar High Court seeking to strike down the amendments.
The counsel in petition is Babar Khan Yousafzai Advocate while amendments were challenged on the grounds that amendments made in LG Act is illegal with mala-fide intention against the law, against the constitution and is liable to strike down.
The writ further stated that in 2001 the local government introduce for first time the evolve departments under the domain of district Nazim was much more than introduce in current Act under which the election had taken place in 2021.
The petition added that the elected representative of the local government contested their elections under the Act which is clearly defines their functions and powers and such substitution of power is aimed to deprive the elected members of Local Government to perform their function.
The writ stating that the substituted such functions and powers from the Principal Act to the “Rules” will only create confusion, instability and conclusively lack of performance and added that the amended act has sabotage the whole Local Govt Hierarchy.
The writ petition seeking interim relief that during pendency of instant writ petition, the operation of the impugned amendments made in LG Act 2013 may kindly be suspended.
