PESHAWAR: Justice Rooh-ul-Amin observed that court cannot trust Anti-Corruption Establishment because it would provide decision in favor of provincial government in case regarding recruitment of Physical Health Education teacher, on Monday.
During hearing counsel for petitioner Sabah-u-Din Advocate and Additional Advocate General Atif Ali Khan appeared before divisional bench of Peshawar High Court comprising of Justice Rooh-ul-Amin and Justice Ishtiaq Ibrahim in writ petition.
The counsel informed that petition was deprived from marks of Master in Physical Health Education on ground that Junior PHE diploma was demanded in the advertisement. He added that petitioner’s qualification is equivalent of Master as per High Education Commission criteria.
The petitioner was appeared before departmental committee constituted of District Education Officer (DEO) Peshawar Samina Ghani, Deputy DEO female Nadia and Section Officer Schools Mian Hussain-u-Din while minutes were provided stated that to include M. PH marks and ordered her appointment as PET post but it was not implemented.
However, AAG Atif Ali Khan argued that available minutes’ sheet with him stating that there is no available seat and positions are filled while Justice Rooh-ul-Amin remarked that it looks like something is made wrong in the issue.
Moreover, he inquired that how can two separate copies of one meeting is issued and added that we know that Anti-Corruption Establishment will decide it in favor of provincial government. Justice Rooh-ul-Amin remarked that if court needs inquiry in this regard then PHC will direct FIA to initiate enquiry while ordered all three members of the committee to appear next hearing on 2nd November.
