PESHAWAR: A divisional bench of Peshawar High Court (PHC) comprising of Justice Ijaz Anwar and Justice Arshad Ali ordered Chief Secretary Khyber Pakhtunkhwa along with Secretary’s Irrigation reply for failure in appointment of Engineer Wilayat Khan as Chief Engineer North despite approval of summary by Chief Minister till 17th March, on Monday.
The counsel Adnan Aman Advocate argued that petition is serving as Executive Engineer in Irrigation department at Mardan. He added that a summary has forwarded for appointment of Wilayat Khan as Chief Engineer North at Irrigation’s department.
Chief Minister Khyber Pakhtunkhwa approved the summary of appointment of Chief Engineer Wilayat Khan on 26th January following procedure while the petitioner is also seniority for nomination, the counsel added.
The other chief engineers are serving as Chief Engineer Merged District and Director General Jabba project approved on 26th January in the summary, the counsel informed. He added that provincial government is playing different delaying tactics in the appointment of petition.
The counsel argued Chief Minister is competent authority for approval while Establishment’s department is obliged to issue notification but the Establishment didn’t issue the notification which is unconstitutional.
The divisional bench of PHC comprising of Justice Ijaz Anwar and Syed Arshad Ali ordered Chief Secretary Khyber Pakhtunkhwa, Secretary’s irrigation along with other respondents to submit reply while adjourned further hearing till 17th March.
