Botanical Garden case: PHC orders to rehabilitate

PESHAWAR: A divisional bench comprising of Chief Justice Peshawar High Court (PHC) Justice Qaiser Rashid and Justice Ijaz Anwar ordered district administration, tehsil municipal administration, public health engineering and Peshawar electricity supply company to address problems regarding provision of electricity and water to Botanical Garden Azakhail, on Thursday.

During hearing Additional Advocate General Syed Sikandar Shah University of Peshawar (UOP) lawyer Wasim-u-Din Advocate, law officer Riaz Ali Khan, Director Botanical Garden Dr. Asad and Additional Deputy Commissioner Qurat-ul-Ain Wazir appeared before court.

Deputy Secretary Higher Education Department (HED) informed that a summary of Rs54.44 million is concluded by Secretary HED which will be utilized for rehabilitation of Botanical Garden Azakhel of UOP. He added that the summary is ready and it should be finalized within one month.

In the meantime, Chief Justice observed whatever the circumstances and situation but restore Botanical Garden immediately because it is necessary.

Additional Advocate General Syed Sikandar Shah informed that district administration and TMA is working for provision of water to the garden but requested court to order public health engineering and PESCO provision of electricity and availability of tube well respectively.
The divisional bench comprising of Chief Justice PHC Justice Qaiser Rashid and Justice Ijaz Anwar ordered all concerned authority to cooperate with Botanical garden’s administration and adjourned further hearing.
