Dissolution of PESCO’s board: PHC orders to submit reply

PESHAWAR: A divisional comprising of Chief Justice Peshawar High Court (PHC) Justice Qaiser Rashid Khan and Justice Ijaz Anwar has ordered respondents to submit reply on supplementary applications regarding dissolution Board of Directors of Peshawar Electricity Supply Company (PESCO) while adjourned further hearing 4th May, on Wednesday.

Two separate writ petitions were filed by Arbab Khuda Dad and Gul Nabi Syed in this regard while added that the petitioners were members of Board of Directors but terminated without any reason.

The writ petitions argued that appointment made for three years while current government has dissolved Board of Directors to adjust their loyal political aids in the PESCO. However, the counsel argued that PHC has stopped removal of Gul Nabi Syed from his position serving as CEO PESCO but the petitioner has removed from services despite court’s orders.

The counsel argued that removal of CEO is unconstitutional while it is also lying under the jurisdiction of Contempt of Court proceedings. The counsel for Arif Sadozai Shumail Ahmad Butt and Barrister Waqar appeared before court.

The counsel Shumail Ahmad Butt Advocate argued that the petitioner has filed amended writ petition while he didn’t possess court’s order in this regard, so, the petition cannot maintainable for hearing.

The divisional bench comprising of Chief Justice PHC Justice Qaiser Rashid and Justice Ijaz Anwar ordered respondents to submit reply on amended writ petition while adjourned further hearing till 4th May.
