It is really beyond the comprehension of the people as to why Khyber Pukhtunkhwa government is inviting consecutive troubles that impact the lives of the people. Before the passage and enforcement of District and Regional Health Authorities Act 2019 and codification of rules and regulations thereon, mass transfers and posting orders of doctors are being issued. Blind approach has been adopted and provisions of spouse posting in government servants rules are being violated as well.
The proposed legislation has been drafted without consultation with stakeholders. Perhaps it may not have been vetted by the relevant high officials of the departments of administration, establishment and law in the civil secretariat before seeking approval of the cabinet. Prior to the tabling of the proposed legislation in the provincial legislature, its subsequent passage, assent of the Governor and codification service rules thereon, the recent transfers and postings of doctors are illegal. Hence the contention of senior doctors to challenge the enforcement of proposed District and Regional Health Authorities Act in court of law is 100 percent valid. It would be worthwhile that Health Minster refrain from misguiding the Chief Executive of the province to recklessly move the handle of 18th Amendment for approving draft legislation that violates the provisions of fundamental rules.
