Establishment of illegal car parking, encroachment: PHC orders to submit within seven days

PESHAWAR: A divisional bench of Peshawar High Court (PHC) comprising of Justice SM Attique and Syed Arshad Ali ordered to submit reply regarding encroachment on Sadr, Fakhr Alam and Kala Bari along with other roads within seven days, on Wednesday.

The writ petition filed by Shaukat Ullah Shah while his counsel Bashir Wazir Advocate and Additional Advocate General Barrister Yasin Raza appeared before court while Deputy Commissioner Peshawar, Cantonment Executive Officer, Secretary Defense, Station Commander, Agriculture’s department and Environmental Protection Agency (EPA) are made respondents in the petition.

The petition stated that encroachment on Saddar, Fakhar Alam, Kala Bari and other roads as well as illegal car parking had established in the premises of Peshawar’s cantonment which has created inconvenience for the public.

The counsel argued that the petitioner had talk to local shopkeepers and traders for removal of encroachment but the business community threatened him despite cooperation in this regard. He added that the petitioner is law abiding citizen while he faces hurdles dissemination of services due to encroachment on footpaths and establishment of illegal car parking as his office situated in Saddar, Peshawar.

As well as the premises is posh area and Very Important Personality (VIP) movement also took place while competent authorities had neglected the issue which is creating human crisis, the counsel stated.

The writ stated Traffic police as well as Chief Executive Officer Cantonment Board also turned blind eyes towards issue because if lifter can seize vehicles from illegal car parking and demolish the encroachment then the issue couldn’t be raised.

Bus Rapid Transit (BRT) routes had already narrowed the roads while establishment illegal car parking in Saddar bazaar has created anxiety among the local populace and traders while government has ignored the crisis, the counsel adds. The competent authorities are requested for several times in this regard but to no veil, the writ stated.

The counsel argued to abolish encroachment from Saddar, Kala Bari and Fakhar Alam road as well as demolishing of illegal car parking and rent a car services to ensure smooth flow of traffic in the premises, however, PHC was informed that respondents didn’t submitted reply in this regard.

PHC’s divisional bench comprised of Justice SM Attique Shah and Justice Arshad Ali ordered DC Peshawar. Chief Executive Officer Cantonment, Secretary Defense, Station Commander, agriculture department and EPA to submit reply within seven days while adjourned further hearing.
