Govt moves Supreme Court to nullify IHC order in Aafia Siddiqui case

ISLAMABAD: The federal government has filed an appeal in the Supreme Court, seeking to overturn the Islamabad High Court’s (IHC) order dated May 16 regarding the case of Dr. Aafia Siddiqui.

In its petition, the government has urged the apex court to declare the IHC’s decision null and void. The appeal argues that the High Court exceeded its constitutional jurisdiction under Article 199 by continuing proceedings in the matter.

According to the government’s stance, the IHC had allowed amendments to Dr. Fawzia Siddiqui’s petition on May 16 — a move now being challenged. The appeal maintains that Dr. Fawzia’s original plea has already been implemented, including the provision of consular access to Dr. Aafia Siddiqui, who is imprisoned in the United States.

The federal government further contends that the ongoing legal process is being unnecessarily prolonged due to repeated amendments in the petition. The appeal also raises concerns over the High Court allegedly stepping beyond its legal mandate in this sensitive diplomatic matter.
