High Court acquits alleged murder

PESHAWAR: A divisional bench of Peshawar High Court (PHC) comprising of Justice Ishtiaq Ibrahim and Justice Sahibzada Asadullah acquitted alleged murder by accepting appeal against his conviction of lifetime imprisonment along with Rs1 million fine, on Friday.

According to prosecution, Amjad Khan has shot killed Abdur Rauf while injured Fazal along with his friends in 2010 in the premises Hangu police station over pathway dispute.

Model Court Hangu in 2022 convicted petitioner for lifetime imprisonment along Rs5 lakh in murder while imposed five years of imprisonment along with Rs5 lakh for injuring other.

The counsel Abdul Fayyaz advocate argued that the crime was happened in the night it didn’t established that who has opened firing while on the other hand several persons are nominated in the First Information Report.

The counsel further argued that prosecution has failed presence of petitioner at the crime scene while police’s evidences are contradictory and requested acquittal of Amjad from his conviction. PHC’s divisional bench comprised of Justice Ishtiaq Ibrahim and Justice Asadullah acquitted Amjad Khan by accepting appeal after conclusion of arguments.
