Muhammadi Medical College case: ‘PHC may issues non bail-able warrant of college’s admin’

PESHAWAR: Chief Justice Peshawar High Court Justice Qaiser Rashid remarked that court may issue non bail-able warrant of Muhammadi Medical College administration if they did not provide original documents to students, on Wednesday.

Justice Qaiser Rashid remarked that it is contempt of court that the college’s administration did not providing original documents and not cooperating with FIA team.

The divisional bench comprising of Chief Justice PHC Justice Qaiser Rashid and Justice Muhammad Ibrahim Khan heard writ petitions of Rizwan Ullah and others while Pakistan Medical Commission lawyer Sangeen Khan, Additional Advocate General Saqib Raza and Additional Attorney General Syed Taufiq Qureshi appeared before court on behalf of federal government.

The counsel for petitioner informed that PMC has adjusted several students in different colleges but Jinnah Medical College lacking capacity to adjust the petitioner students due to faculty shortage, however PMC lawyer argued that the college’s registration was approved after fulfillment of facilities and have faculty members but PMC shall monitor it for six consecutive months.

The college’s principal informed that all facilities are available while faculty shall start classes from Monday while FIA informed PHC that Muhammadi College administration refused to provide original document of students by claiming that it is in possession of college’s lawyer.

During hearing PHC has directed to obtained original documents from lawyer and if college’s administration did not providing the document then the competent officials shall be produce in chains before court.

PHC directed Advocate General KP to uphold the issue the college and competent because court may issue non bail-able warrant while AG Shumail argued that he will discuss the issue with both the college’s administration and police high ups.

The divisional bench directed AAGs to obtain original documents and provide to students after assurance from college’s lawyer regarding provision of original documents and adjourned further hearing till 15 July.
