PESHAWAR: Peshawar High Court (PHC) on Thursday directed Additional Attorney General (AAG) to submit Federal Cabinet minutes and Council of Common Interests (CCI) regarding gas tariff announced for Tandoors.
Mutahida Chai Faroshan had filed writ petition against Oil and Gas Regularity Authority (OGRA) and Federation of Pakistan.
The petition stated that OGRA had established separate category for Tandoors which is discrimination against other commercial gas users.
AAG Syed Habib Qureshi represented Federation and OGRA and argued the case before honorable court.
AAG informed PHC that CCI discussed the matter and announced special category for Tandoors due to its important role in providing breads and included it in basic commodity.
AAG Syed Habib Qureshi argued that proper forum for complaint against tariff as OGRA.
The counsel for petitioner argued that they had challenged special category granted to tandoors which is discrimination with other businesses.
During hearing Chief Justice PHC Justice Waqar Ahmad Seth remarked that honorable court would utilize power of judicial review.
The two-member bench comprising of Justice Waqar Ahmad Seth and Justice Nasir Mehfooz heard the petition and directed to submit comments of Federal Cabinet and CCI decision regarding gas tariff and case was adjourn till March, 12.
