PHC directs CS, IG registration to submit comments

PESHAWAR: A divisional of Peshawar High Court comprising Justice Rooh-ul-Amin and Justice Ishtiaq Ibrahim directed Chief Secretary Khyber Pakhtunkhwa and Inspector General Registration along with others to submit comments for granting additional charge of Sub-Registrar to Tehsildar, on Tuesday.
The counsel for petitioner Danyal Asad Chamkani Advocate informed that Tehsildar may be appoint as Sub Registrar while a notification was issued in 1993 in this regard but provincial government had amended the rules in 2020 stating that Tehsildar neither be appoints as Sub-registrar nor can hold additional charge.
The counsel argued that despite the amendments Tehsildars had appointed as Sub Registrar Kohat, D I Khan and Swabi district which is against the law.
The divisional bench directed Chief Secretary, SMBR and Inspector General Registration Department to submit comments before next hearing on writ petition of Ghani-ur-Rehman.
