PESHAWAR: A divisional bench of Peshawar High Court (PHC) comprising of Justice Ibrahim Khan and Justice SM Attique Shah ordered provincial government along KP Revenue Authority to submit comments in case regarding contracts of solarization project, on Wednesday.
The counsel Babar Khan Yousafzai Advocate informed that petitioner M/S NMC company has withdrawn from bidding process despite holding qualification required in this regard.
The counsel added that petitioner’s company placed in registered from 2019 to 2022 while in the meantime NMC has applied contract and respondents had selected only 10 firms out of 26. He added that MNC Company was excluded on grounds of didn’t filling tax-returns and lack of credit lane.
The counsel Babar Khan Advocate argued that MNC was placed in registered list for three years which means that it has qualified rules and regulation. He added that petitioner was excluded from bidding to grant contracts on nepotism.
The counsel added that MNC has filed appeal before KPRA while the authority asserts availability of credit but declared that company didn’t filed tax-returns. He claimed that tax-returns documentation is present before court while it was also produced to KPRA.
The divisional bench of PHC comprising of Justice Ibrahim Khan and Justice SM Attique Shah directed provincial government along with KPRA to submit reply while adjourned further hearing till date to be fix.
