PHC suspends notice issued to Tourism cops

PESHAWAR: A divisional bench of Peshawar High Court (PHC) comprising of Justice Abdul Shakoor and Justice Syed Arshad Ali has suspended notice issued to 75 Tourism police personnel for does not extending their services while ordered respondents to submit reply, on Thursday.

The counsel Asif Yousafzai Advocate informed that Mustafa Khan along 74 other petitioners were recruited as constables in Tourism police on 5th May 2022 while they had completed their training but PHC has directed to stop extension to candidates who lacks driving license in writ petition of two 3rd Division holders.

The petitioners had filed petition under Section 12(2) of Civil Procedure Code (CPC) while pleaded who can a decision be intact without hearing the beneficiary/ effect parties, however, PHC has declared it didn’t passed orders against the petitioners, so how can they file 12(2) CPC petition, the counsel argued.

However, in May 2023 a notice has been issued to petitioner that their services shouldn’t be extended as per High Court’s decision and added that advertisement didn’t made holding of driving license as mandatory while inscribed that license-holders will be prioritized, the counsel stated.

The counsel argued that PHC has declared that court didn’t passed any orders against petitioners but their extension has been stopped on the ground of High Court’s judgement which is illegal while court has suspended notice issued to tourism police personnel and ordered to submit reply.
