PESHAWAR: Peshawar High Court has fixed writ petition against usage of funds by Chief Minister Khyber Pakhtunkhwa and Minister for Finance under discretionary powers for on 29 June and proceeding was adjourned due unavailability of Advocate General Shumail Butt.
The two member bench of Chief Justice PHC Justice Qaiser Rashid adjourned proceeding in writ filed by Member Provincial Assembly Khushdil Khan Advocate stating that 13% of developmental funds shall be provided to local governments and 2% is reserved for discretion of Chief Minister and Minister for Finance Khyber Pakhtunkhwa.
The writ stated that discretionary powers of CM and finance minister against fundamental rights and requested for abrogation of discretionary developmental funds.
During hearing Additional Advocate General Syed Sikandar Shah appeared before PHC and informed that this case is before AG Shumail Butt if he gives permission then he will be able argue the case.
Subsequently, Khushdil Khan Advocate argued that this writ pending since 2019 and it did not decide due to adjournments and that Additional AG may empower to argue the writ in absence of Advocate General Khyber Pakhtunkhwa.
The two member bench adjourned further hearing till 29 June and directed Advocate General KP to appear before court or empower AAG to argue the writ petition.
