PESHAWAR: A divisional bench of Peshawar High Court (PHC) comprising of Justice Ijaz Anwar and Justice SM Attique Shah ordered Secretary’s Health for submission of reply for didn’t release salary of class-IV employee at District Headquarters (DHQ) Hospital Mardan from last 13 months, on Tuesday.
The counsel Malak Shahbaz Advocate argued that Shah Zeb is recruited at DHQ hospital Mardan as class-IV while performing his duties regularly but his salary isn’t released from last 13 months.
The counsel argued that provision of compensation for delivery of services is obligation of government as per Article 11 of Constitution of Pakistan as well as under sections 6 and 53 of the concerned rules which is violated in the case.
The petitioner is performing his duties at the concerned office and inquiry didn’t concluded in this regard, the counsel added.
He argued for release of arrears and salary till decision of writ petition.
PHC’s divisional bench comprising of Justice Ijaz Anwar and Justice SM Attique Shah ordered for provision of reply as well as inquired that why inquiry didn’t conclude within one year while adjourned further hearing till date to be fixed.
