Supreme Court stops CJ PHC from hearing WWB KP case regarding formation of larger bench

ISLAMABAD: The Supreme Court on Friday stopped the Chief Justice (CJ) Peshawar High Court (PHC) from hearing Wor-kers Welfare Board (WWB) Khyber Pakhtoonkhwa petition seeking formation of larger bench.

A two-member bench of the apex court comprising Chief Justice Gulzar Ahmed and Justice Ijaz Ul Ahsan heard the case.

During the course of pr-oceedings, the Chief Justice said that the Peshawar High Court’s bench No. 1 could  not hear the petition of the Welfare Board.

The court also summoned Registrar PHC to appear before  the court on next date of hearing.

The court issued notices to the Attorney General and the Advocate General KPK.

Advocate Azhar Rasheed counsel for Workers Welfare Board said that a case was pending in the bench number one of the Peshawar High Court.

He said that the high court was constantly ignoring several Supreme Court decisions. He said that he had pleaded the court to form a larger bench which was rejected. He pleaded the court to issued directions regarding decision of the case on merit.

The Chief Justice asked was the Peshawar High Court ignoring the Supreme Court verdict?

The counsel responded that only bench headed by Chief Justice PHC was ignoring the apex court decisions.

Later, hearing of the case was adjourned for one week.

Afghan citizen’s appeal for house possession turned down: Supreme Court Friday dismissed an Afghan citizen’s request to return the possession of property.

A two-member bench of the apex court comprising Justice Umar Ata Bandial and Justice Qazi Muhammad Amin Ahmed heard the case.

During the course of proceedings, Justice Umar Ata Bandial asked the counsel for the proof about the house buyer whether he was an Aghan origin.

The counsel for the petitioner Shamoon disclosed that Zafar Khan’s two identity cards were on record. His first and second identity cards had two different numbers, he added.

He said Zafar Khan did not provide any identity proof when he bought the house.

He said the fake identity card was also presented to the court.

Justice Umar Ata Bandial asked the counsel why he did not raise this point in the district court and the high court?

He said the district court and high court had issued decree regarding the house in favour of Zafar Khan.

The court after hearing arguments said Zafar Khan, the buyer of the house, was an Afghan citizen and this point was not raised in the subordinate courts therefore, under the Foreign Act, no foreigner could buy property in Pakistan.

The court also rejected the request to issue a stay order in the case.
