PESHAWAR: Chief Justice Peshawar High Court (PHC) Justice Qaiser Rashid remarked that provincial government is renaming institutions despite focusing on good governance and adopting new reforms which neither bring change nor improved performance of the departments, on Tuesday.
The Chief Justice observed this during hearing of writ petition filed by chairman Shiekhabad ward Muhammad Munir and Awais Sardar against closure of park in the premises which has deprived residents from entertainment and healthy facilities while it became a place for garbage.
During hearing petitioner Awais Sardar, Peshawar Development Authority counsel, Waqaf Amlak Board lawyer and government representative appeared court while Chief Justice inquired from Waqaf trust about resolution of the issue.
However, Waqaf trust lawyer informed PHC that it is the trust property while lease amount did not provided and the park was sealed on orders of Supreme Court.
Chief Justice Qaiser Rashid directed trust and PDA lawyers to sit together for resolution of the issue while directed to open the park for the purpose of beauty and inquired regarding jurisdiction of the park.
PDA counsel informed that it is was property of town-1 but after establishment of metropolitan the park transferred to the jurisdiction of City’s mayor.
The divisional bench comprising of Chief Justice PHC Justice Qaiser Rashid and Justice Arshad Ali directed to ensure protection of saplings in the park while also ordered consultation among competent department to resolve the issue and adjourned further hearing till 5 October.
