FIRs in wake of 9th& 10th May vandalism: PHC dispose-of writ petition following submission of record

PESHAWAR: A divisional bench of Peshawar High Court (PHC) comprising of Justice Shakeel Ahmad and Justice Shahid Khan has dispose-off writ petition on submission of cases record registered against former Advisor to Chief Minister Shakeel Ahmad while stopped harassment of the petitioner, on Tuesday.

Assistant Attorney General Hazart Syed, Assistant Advocate General Barrister Yasin Raza and Malak Muhammad Ajmal Khan advocate appeared before court.

The counsel Malak Muhammad Ajmal Khan advocate informed that petitioner served Khyber Pakhtunkhwa twice as Advisor to Chief Minister while argued Shakeel Ahmad is booked in two Anti-terrorism Act cases, two Anti-corruption and arrested under Maintenance of Public Order (MPO) twicely as per Deputy Commissioner Malakand orders.

The counsel argued that petitioner is re-arresting following his release on bails while concerned authorities didn’t providing copy of First Information Reports (FIRs) registered against him which isn’t fair. He added that if federal or provincial government has evidence against Shakeel Ahmad then tried him before court of law.

In the meantime, Barrister Yasin Raza informed that total four FIRs are registered against Shakeel Ahmad and added that petitioner had obtained bail in three cases but put behind bar in Anti-corruption case. He added that one warrant under MPO is declared void by court while other one is suspended and argued for disposal of the petition.

However, Malak Ajmal Khan advocate requested for relief like Ali Muhammad Khan to stop arrest of Shakeel Ahmad another case but Barrister Yasin Raza opposed it by stating that in future criminal will obtain benefit from the court’s order following commencement of offense.

Moreover, Malak Ajmal advocate requested PHC to intervene in the current situation because PTI workers facing victimization over their political affiliation, while Justice Shakeel Ahmad observed that court neither see the face of petitioner but granting decision as per law.

PHC’s divisional bench comprising of Justice Shakeel Ahmad and Justice Shahid Khan dispose-off writ petition after submission cases record registered against Shakeel Ahmad while stopped harassment of PTI’s activist and ordered for provision of record of new cases in future.
