Housing Societies’ victims: PHC fixes 9th April for final hearing

PESHAWAR: Peshawar High Court (PHC) to decided pleas of housing societies’ victims on 9th April while clipped cases of Al Masa and Professor Model Towns’ sufferers with identical petitions for final arguments, on Thursday.

PHC’s divisional bench comprised of Justice Ijaz Anwar and Waqar Ahmad adjourned hearing on pleas filed Malak Shahbaz Khan advocate on behalf of Dr. Shahid and Sherin Fatima along with others.

The petitioners had purchased plot at Al Masa Model Town from its own Dr. Hameed Jan but latterly the project was hand over to Professor Model Town operation Dr. Nauman, the petition stated. However, Dr. Nauman denied possession of plot to petitioners when they approached the premises with the claim that Dr Hameed had obtained payment in this regard.

The counsel Malak Shahbaz advocate stated in the plea that applicants are public servants and the victims number reaches to hundreds. He added that Dr. Hameed Jan had approached High Court in writ plea seeking withdrawal of his name from Exit Control List (ECL) and restoration of bank’s accounts.

However, Dr. Hameed and Dr. Nauman lawyers argued that for delisting their names from ECL as well as restoration of bank’s accounts seized by National Accountability Bureau (NAB).

PHC’s divisional bench comprising of Justice Ijaz Anwar and Justice Waqar Ahmad clipped all identical pleas for final arguments while adjourned further hearings till 9th April.

It is worthy mention that hundreds of victims of Al Masa Model Town had filed with NAB and arguing for provision of plots and denied receiving of compensation as per 2007 property value.
