PHC reinstates Dr Salman as member syndicate

PESHAWAR: A divisional bench of Peshawar High Court (PHC) comprised of Justice Ijaz Anwar and Justice Shakeel Ahmad reinstated Dr Salman Ullah as member syndicate at Kohat University of Science and Technology while declaring earlier termination null and void.

The counsel Akhundzada Ahmad Saeed advocate argued that the petitioner is an Assistant Professor at Department of Pharmacy and serving the teacher’s association as president of the varsity. He added that the petitioner’s syndicate membership was abrogated on 4th July 2023 by Vice Chancellor KUST as he objected on several issues which is unconstitutional as well as illegal.

The counsel further argued that Dr Salman Ullah had made applicant before Vice Chancellor but he didn’t decide it despite passage of several months. He added that Vice Chancellor had no jurisdiction to terminate the syndicate’s membership. Vice Chancellor Kohat University of Science and Technology had terminated syndicate membership of Dr Salman with the observation that the applicant didn’t represented his position properly, the counsel argued.

PHC’s inquired from varsity’s lawyer under which law Vice Chancellor KUST had terminated Dr Salman Ullah syndicate membership while he informed that VC had powers to made such decision while adding that the petitioner can make appeal against the decision.

However, PHC observed that the varsity ‘s lawyer arguments and evidences didn’t satisfied the court regarding termination syndicate’s membership while declared VC KUST orders null and void as well as reinstated Dr Salman Ullah as member syndicate.
