PESHAWAR: The two member bench comprising of Chief Justice Peshawar High Court Justice Qaiser Rashid and Justice Ijaz Anwar directed sugarcane Commissioner to appear before court in case regarding to fulfill demands of sugar mills of Khyber Pakhtunkhwa, on Wednesday.
The counsel for Premier sugar mill Mardan Qazi Jawad Advocate informed PHC that due to shortage sugarcane the sugar mills in Khyber Pakhtunkhwa are compelled to import sugarcane from Punjab and added that it is responsibility of sugarcane Commissioner to ensure fulfillment sugar mills demands.
The counsel Qazi Jawad Advocate further added that farmer had making Jaguar from sugarcane which had made shortage sugarcane for sugar mills.
During hearing Justice Ijaz Anwar remarked that in recent shortage sugar, sugar mill mafia along with local administration Punjab had stopped framer from selling sugarcane for Jaguar and closed Jaguar plants.
Justice Ijaz Anwar remarked that mill owners are purchasing sugarcane at cost which is not acceptable for farmers.
Subsequently, Chief Justice PHC Justice Qaiser Rashid remarked that mill owners must have to show flexibility because if Jaguar making more profit for farmers then who can they sell sugarcane to sugar mills. Chief Justice added that if everyone seeks profit and they are small scale farmers.
The counsel for petitioner Qazi Jawad Advocate argued that address their grievances and ensure provision of sugarcane to mills under the law because if the sugar mills were closed then one hand it will bring losses for investors and on the other hand thousands of workers will become unemployed.
Additional Advocate General Syed Sikandar Shah informed PHC that if any order will pass then farmers will knock doors of court that they were not heard in the case.
Chief Justice PHC Justice Qaiser Rashid remarked that the wants to hear everyone affecting from the case and added that farmers are not willing to sell sugarcane on price fixed by the government.
The counsel for petitioner informed that court can may refer the case to sugarcane commissioner but PHC has directed sugarcane Commissioner to appear before court and adjourned further hearing.
