Establishment of car parking on graveyard: PHC directs DIG to hand over land to PDA

PESHAWAR: A divisional bench comprising of Chief Justice Peshawar High Court Justice Qaiser Rashid and Justice Attique Shah directed Special Security Unit to release seven Kannal land of car parking to Peshawar Development Authority (PDA) which was established in the premises of Hayatabad’s graveyard, on Wednesday.

During hearing chief justice Qaiser Rashid remarked that governments had distributed land in Hayatabad on nepotism in past including land of graveyard.

The writ petition has filed by Sahibzada Afridi while Additional Director General PDA Ijaz Afzal, Deputy Inspector General Special Security Unit (SSU) Zafarullah Khan, Assistant Advocate General Muhammad Saqib Raza and PDA’s lawyer Haris Safi Advocate appeared before PHC.

Additional DG PDA Ijaz Afzal informed PHC that initially a proper land was allocated to police in Hayatabad for establishment of Chowki to provide security to residents but in 2008 further two Kannal land was allocated to law enforcement agency due to insurgency in the region to establish further infrastructure to ensure security of local residents.

However, Chief Justice Qaiser Rashid remarked that it was land of graveyard while ADG argued that PDA have no further land in the premises but court was informed that SSU had established car parking on seven Kannal of graveyard.

DIG SSU Zafarullah Khan informed PHC that the land was unoccupied and far away from graveyard while added that neither a boundary wall is constructed but it is utilized for vehicles at different occasion, however Chief Justice observed that graveyard’s land shall not be utilized for any other purpose.

The divisional bench of PHC directed DIG SSU to hand over seven Kannal land of graveyard to PDA and ordered ADG to acquire the land immediately and construct boundary wall and write that the purpose of land that it is graveyard’s land allocated for residents of Hayatabad.

Moreover, ADG informed that Section-4 has imposed on 200 Kannal land at Achenai while provincial government granted Rs,300 million which shall be acquired soon, while Chief Justice directed In-charge SSU to hand over land except two Kannal to Peshawar Development Authority immediately.
