Heirdom certificate’s fee: PHC seeks reply

PESHAWAR: Peshawar High Court (PHC) ordered Attorney General of Pakistan (AGP), National Database and Registration Authority (NADRA) and provincial government to submit reply regarding fee fixed at Rs10 thousand heirdom certificate, on Thursday.
The petition stated that the increase in fees for heirdom certificate is against Article 141 of Constitution of Pakistan which will increase problems of citizens because high inflation has already evoked every segment of society while the writ was filed by Salim Shah advocate.
The petition argued that the act has empower NADRA while it is unconstitutional because provincial government can’t give directions to federal departments. Rs5 thousand should be payable for duplicate certificate while Rs10 thousand will be charged on property worth less Rs1 million.
The wit further argued that Section stated; without decline certificate one’s can’t approach the court for the grievances which has created problems for the citizens and violating the Constitution of Pakistan. The court’s jurisdiction has also curtain which has further deepen the grievances of public while PHC has approached in accordance with problems facing by citizen while requested declaring it null and void.
However, PHC ordered AGP, NADRA and provincial government for submission of comments in this regard while adjourned further hearing. PHC’s divisional bench comprised Justice Syed Arshad Ali and Justice Dr. Khursheed Iqbal granted bail to former Member National Assembly (MNA) Sabghat Ullah while declared void his arrest under Section-3 of Maintenance of Public (3MPO).
The counsel Alam Khan Adenzai advocate argued that former MNA was arrested on 5th August under 3MPO from Dir following 9th& 10th May vandalism after arrested of Imran Khan by National Accountability Bureau. Similarly, PHC has confirmed interim bail of former MPA Zahir Shah Toru while stopped his arrest and ordered submission of record of cases registered against the applicant. The counsel argued that former MPA was nominated in several cases after 9th May following arrest of Imran Khan by NAB in corruption charges while Zahir Shah Toru has nothing to do with the vandalism.
