Issuance of CNIC to foreign spouse: PHC orders NADRA to submit reply

PESHAWAR: A divisional bench of Peshawar High Court (PHC) comprising of Justice Ishtiaq Ibrahim and Justice Sahibzada Asadullah ordered Ministry of Interior and National Database and Registration Authority (NADRA) to submit comments, on Wednesday.

The counsel Mian Zakir Hussain Advocate informed that petitioner Amina married with foreigner while NADRA didn’t issue Computerized National Identity Card (CNIC) to her husband.

The counsel argued that anyone marry with Pakistani men obtains Pakistani citizenship as per Citizen Act but in this petitioner facing discriminatory attitude as women neither provided citizenship to her husband belongs to Afghanistan nor CNIC was issued to him.

The counsel further added that PHC and Federal Sharia’t Court has along has granted judgements in this regard by declaring that foreigners married with Pakistani women are entitled for citizenship while argued several identical cases are placed before different courts.

The counsel informed PHC that police harassing petitioner’s husband Najeeb Ullah while requested to issue Pakistani citizenship and Pakistan Origin Card.

The divisional bench of PHC comprised of Justice Ishtiaq Ibrahim and Justice Sahibzada Asadullah ordered Ministry of Interior (MOI) and NADRA after initial arguments while adjourned further hearing.
