PHC directs ES&ED to release salary of employee

PESHAWAR: A two-member bench of Peshawar High court (PHC) comprising of Justice Rooh-ul-Amin and Justice Ishtiaq Ibrahim has directed Elementary and Secondary Education Department to release salaries of Assistant Director at the department, on Tuesday.
The writ petition filed by Munir Ullah Shah seeking release of salaries who is serving at ES&ED while Justice Rooh-ul-Amin remarked that how can you withhold someone salary and added that competent authority do not aware of rules and regulations.
The counsel for petitioner Munir Ullah Shah, Zahir Shah Marwat Advocate informed the court that the petitioner is an Assistant Director at ES&ED and regular on duty but due to one or two day late arrival for duty had made base for withholding of salary.
The counsel further added that petitioner was transferred without approval of summery and their salary was also stopped. The court was informed the petitioner does not come to the office on time does not work therefore he has been transferred and salary has been withheld and pay off.
Justice Rooh-ul-Amin further remarked that if an officer does not perform his duty then the employee must be transfer to another place for smooth delivery of services. As long as they do not leave the charge here the salary is their right while Justice Ishtiaq Ibrahim informed the petitioner you also go on time for duty, if you do not do duty then we will order to send you home.
The divisional bench of PHC directed Directorate and ES&ED department to release salary of Assistant Director and disposed-off the writ petition.
