PHC stops disposal of mining wastage in leased property

PESHAWAR: A divisional bench of Peshawar High Court (PHC) comprising of Justice Shakeel Ahmad and Justice Khursheed Iqbal stopped disposing mining wastage in the leased land of Malak Mining Company.

PHC ordered Yousaf Mining Company for provision of pathway to the petitioner to access his property and emerald’s mine as well as stopped from disposing mining wastage in private and leased property.

The counsel Nauman Mohib Kakakhel advocate argued that petitioner possessing lease of 50 acres of mountain for emerald mining while Yousaf Mining Co; obtained only five acres of land.

Earlier, Yousaf Mining Company creating hurdles for petitioner in emerald mining but it was stopped on intervention of the High Court but now disposing mining wastage in leased land of Malak Mining Company, the counsel stated.

The counsel added that disposing of mining wastage is the liability of every mining company. He added that Mining Laws compelling companies to ensure 400 meters distance between explosive for mining and private properties and requested to stop Yousaf Mining Co; from disposing of mining wastage in petitioner’s property.

PHC’s divisional bench comprised of Justice Shakeel Ahmad and Justice Dr. Khursheed Iqbal stopped Yousaf Mining Company from disposing of mining wastage in leased and private land of Malak Mining Company while ordered for submission of reply.
