Treason case: Musharraf’s lawyer files petition to dismiss case

ISLAMABAD: Legal counsel of former military dictator Gen (retd) Pervez Musharraf’s has submitted a petition in the special court to dismiss the high treason case, on Thursday.

According to details, Musharaf’s lawyer, Salman Safdar stated that the case was filed against the former president without getting approval from the cabinet. He added that Pervez Musharraf is being harassed continuously.

Statement under Section 342 cannot be recorded in the absence of Gen (retd) Pervez Musharraf, and the presence of the accused is mandatory for conviction, the lawyer said.

Salman Safdar further told the court that Pervez Musharraf is admitted to hospital to undergo chemotherapy.

Justice Tahira Safdar inquired from the counsel that what should the court do if the suspect does not appear before it, upon which Salman Safdar replied that the presence of lawyer means the accused is present.

Justice Tahira Safdar asked if the counsel too does not appear. Salman Safdar said the court then appoints a lawyer itself under Section 9.
