PHC orders govt to submit comments

PESHAWAR: A divisional of Peshawar High Court (PHC) comprising of Justice Rooh-ul-Amin and Justice Ishtiaq Ibrahim ordered Khyber Pakhtunkhwa government, law, secretary local government and Advocate General to submit comments in writ against Khyber Pakhtunkhwa Local Government Act amendments (2022), on Tuesday.

The writ petition was filed by City Mayor Haji Zubair Ali and chairman Village Council Pakha Ghulam Malik Muhammad Nawaz Khan while petitioner’s counsel Qazi Jawad Ihsanullah along with Mian Zakir Hussain Advocates appeared before PHC.

The petition argued that recent local government elections were held under Khyber Pakhtunkhwa Local Government Act 2013 while amendments were placed before provincial which was adopted on 3rd June 2022 which has curtain power and procedure both for tehsil mayor along with village council chairman.

The counsel informed that amendments made municipal services under provincial government jurisdiction along with provision of funding while several powers have been curtain from tehsil mayor which will weaken whole local government system.

The counsel further argued that amendments shall create hurdle in transfer of power to gross root level while PHC has ordered respondents including government of Pakhtunkhwa to submit comments and adjourned further hearing.
