High Court turndowns writ against UOP

PESHAWAR: A divisional bench of Peshawar High Court (PHC) comprising of Justice Ijaz Anwar and Justice Syed Arshad Ali has turndown writ of student against Islamia Law College, University of Peshawar, on Thursday.

During hearing Legal Officer UOP Riaz Ali Khan and varsity lawyer Jahan Zeb Muhammadzai advocate appeared before PHC.

The writ by student of Islamia Law College named Usama Zia stated that he has passed 1st semester of LL.B at the said institute but didn’t appeared before in 2nd semester examination due to illness.

The petition stated that petitioner had applied for 3rd semester exams but it is withdrawn by university administration despite the varsity has jurisdiction to arrange make-up exam for the student to clear previous papers.

UOP lawyer argued that student should must clear 50% papers to eligible for exam of next semester but the petitioner didn’t appeared in the 2nd semester examination at all.

However, PHC declared that it is administrative jurisdiction of university and court may not interfere in the matter because Supreme Court of Pakistan has granted several judgements in this regard.
