PHC seeks reply from UET in Grade 21 promotion case

PESHAWAR: A divisional bench of Peshawar High Court (PHC) comprised of Justice Ijaz Anwar and Justice Shahid Khan ordered University of Engineering and Technology (UET) Peshawar’s administration for submission of response to a petition against five years-experience for promotion to 21Grade, on Wednesday.

The counsel Zia ur Rehman Tajik advocate argued that applicant Professor Dr. Khan Shahzada is eligible for promotion in Grade 21 as he has three and a half years of experience while according to the criteria of Higher Education Commission two years of experience is required. In the light of HEC and provincial laws the UET UET criteria of five years of experience is unconstitutional, the counsel added.

The counsel further argued that UET five years of experience policy also contradicts with the HEC and provincial laws which require only two and three years of experience, respectively.

PHC’s divisional bench comprising Justice Ijaz Anwar and Justice Shahid Khan issued a notice to the university administration, seeking a response to the petition while adjourned further hearing in the case.

It is worthy to mention that the applicant had challenged UET’s advertisement, which requires minimum of five years of experience for promotion to Grade 21, and argues that this condition is illegal and unfair.

The petitioner is seeking relief from the court, including a declaration that the university’s requirement is unconstitutional and an order directing the university to consider his application for promotion.
