SC rejects Daniyal request to summon PEMRA officer

ISLAMABAD: The Supreme Court of Pakistan (SCP) on Monday rejected Daniyal Aziz counsel’s request for summoning PEMRA director (monitoring) again.

The court also declared Javed Hashmi’s statement irrelevant.

Earlier, counsel for Aziz, Ali Raza, had moved an application, requesting to summon defence witness, who is Pemra Director (Monitoring), along with the video regarding Javed Hashmi’s news conference he held on January 1st last year.

The Aziz counsel said that it was a necessary evidence to establish defence of his client in the interest of justice. During the hearing, Justice Sheikh Azmat Saeed remarked please don’t use delay tactics, adding that following the right direction would be in your benefit.

According to details, a three-member bench headed by Justice Sheikh Azmat Saeed heard the contempt of court case against Daniyal Aziz on Monday.

Aziz counsel presented a CD of Hashmi’s press conference in the court, requesting to make it part of the record.

Regarding request of summoning Pemra director, Justice Azmat Saeed said he had already been summoned the Pemra director and summoning him again would be nothing more than waste of time.

Aziz counsel informed the court that the witness had not presented the record which was relevant to the case, adding reconfirmation of the footage of a private TV channel is needed.

Upon which, Justice Azmat said you could called the concerned witness with relevant record, adding that you had already accepted theme of the footage.

The counsel said that the TV channel footage was edited whereas unedited video is need.

Opposing the request, Prosecutor Raja Waqar said the petitioner witnesses were irrelevant, adding that the court had no issue with the editing stuff.

Justice Azmat Saeed said if the defence counsel has issue with the footage editing then original video can be called.

What do you think someone else had spoken in the voice of Daniyal Aziz?, adding that doing that is too difficult. The court said cross examination had been done regarding the footage.

The apex court rejected Aziz counsel’s request to summon Pemra Director Haji Adam again. However, allowed the defence counsel to summon the second witness, Kashif Jabbar.

The court remarked that the court however, full filing the court legal procedure allowed the defence lawyer to present Kashif.

The case has been adjourned till April 24.
