Secret detention of people is unconstitutional says SC

ISLAMABAD: Supreme Court has declared that secret detention  is unconstitutional and unlawful during the hearing of missing persons case.

Unfortunately secret agencies have not told truth to the court and that is why secret agencies have lost their credibility. Whosoever has committed any crime should be punished. And from year to year people are in secret detention. According to law within 24 hours detainees should be presented before the magistrate.

A three member bench headed by Justice Ajaz Afzal heard the case.

During the hearing Additional Attorney General told the court that in accordance with the order of the court Tasif Malik met his family members in the detention centre. On this the father in law of Tasif Malik told that four guards were present during the three minute meeting. At this justice Aijaz Afzal questioned that court wants to know the charges against Tasif Malik and for which crime and under which law has been arrested.

Justice Aijaz Afzal questioned public prosecutor about the disappeared Adil Khan. At this public prosecutor told the court that he has written to the agencies and their response is still awaited.

Chairperson of Human Rights Amana Masud Janjua told the court that for the last seven years the  families of disappeared persons have lined up. One case came up for hearing after the lapse of seven months and it is a matter of 30 years plan.

Justice Aijaz Afzal questioned public prosecutor the progress about the case of Muddasar Iqbal. Public prosecutor said according to agencies report no clue has been found.

Amana Masud Janjua told the court that in the UN report there is a mention of Muddasar Iqbal and he is in secret custody.

Justice Aijaz Afzal said why the trials are not being held of persons in the detention centres.

Justice Dost Mohammad said that the book of constitution should be part of syllabus. Whosoever committed any crime should be punished under the law.

Justice Aijaz Afzal said that no one can be kept in custody sine die.

During hearing mother of Faisal Faraz appeared in the court and said that his son is untraceable for the last 12 years. She said the state will not die and we have to die.

The court adjourned the hearing of the case till January 9.
