Women Property Act: PHC orders Law & Justice Dept for necessary actions

PESHAWAR: Peshawar High Court has observed that government may amendment Provincial Ombudsman laws to protect inheritance rights of women while forwarded the petition to Department of Law for necessary actions in various cases.

Justice Syed Arshad Ali of PHC further observed that unfortunately women are depriving from their rights in inheritance while added that provincial government must look into current laws and amend it to protect female folk’s rights.

The counsel for petitioner Ghulam Mohi-u-Din Malik Advocate informed that provincial government has passed Khyber Pakhtunkhwa Enforcement of Women Property Act 2019 which has empowered Provincial Ombudsman to seal disputed property in which female especially widows are deprived from their inheritance.

The counsel further added that such decision sometimes depriving both parties from their fundamental rights because the property is only source of income for the family and identical situation was faced by applicant woman from 18th June 2021 decision in which property were sealed under the 2019 Act.

PHC declared that Khyber Pakhtunkhwa Enforcement of Women Property Act 2019 didn’t provide clear procedure for disputed inheritance’s property while the court forwarded the issue to Law & Justice department for necessary actions.
