Blockage of road in front of Assembly: PHC directs to submit comments

PESHAWAR: The two member bench of Peshawar High Court comprising of Justice Atique Shah and Justice Syed Arshad Ali issued to Government of Khyber Pakhtunkhwa, Deputy Commissioner and Chief Capital City Police Officer to submit comments in case regarding blockage of Khyber Road in front of provincial assembly, on Monday.

A pro bono petition has been brought by Ali Gohar Durrani Advocate on behalf of seasoned and well reputed journalist Muhammad Jamshed Khan (Baghwan).

The Petition has laid down that per the Constitution of Pakistan under Article 15 the right to freedom of movement of the public cannot be brought to an end with the protest of a handful of people who block the road near Provincial Assembly creating chaos for patients, elderly, children and woman.

References have been made to various judgments of the Peshawar High Court, Islamabad High Court, Supreme Court of Pakistan, Indian Supreme Court as well as judgments from the United Kingdom.

The honorable bench after hearing preliminary arguments admitted the petition for regular hearing and directed the Government of Khyber Pakhtunkhwa, DC and CCCPO Peshawar to submit comments.
