Disable quota: PHC orders KMU to argue on 10th Jan

PESHAWAR: Justice Ijaz Safi of Peshawar High Court (PHC) has issued notice to Khyber Medical University (KMU) in writ regarding declaration students as disable who were declared fit (not disable) in previous 2021-22 session to argue the petition on 10th January, on Tuesday.

The writ petition filed by Haroon Hameed who is enrolled in Bachelor of Dentistry Sciences (BDS) while challenged admission of Haris Zaman and Jahangir Bacha in MBBS on disable quota.

The counsel for petitioner Zia-ur-Rehman Tajik Advocate informed that Haris Zaman and Jahangir Bacha were declared fit (not disable) by KMU’s medical in session 2021-22 while in this session the same declared them as disable.

The counsel Zia-ur-Rehman Tajik Advocate argued that once Haris Zaman and Jahangir Bacha as declared by KMU’s medical board in 2021 session then in the current session who the same body declare the respondents as disable and granted admission in MBBS degree.
The counsel argued that if the Haris Zaman and Jahagir Bacha excluded from disable merit list then the petitioner will stand on 5th position in merit list and will be able to obtain admission in the discipline of MBBS degree at KMU.

PHC’s single bench comprised of Justice Ijaz Safi ordered KMU to argue the petition on 10th January while issued notices to respondents after initial arguments.
