PHC adjourns hearing on KP CM plea against NAB

PESHAWAR: A two-member bench Peshawar High Court (PHC) comprising of Justice Ijaz Anwar and Justice Shakeel Ahmad adjourned hearing Khyber Pakhtunkhwa Chief Minister Ali Amin Gandapur plea against National Accountability Bureau (NAB) notice on petitioner’s lawyer request, on Wednesday.

The lawyer representing the Chief Minister, Alam Khan Adeenzai advocate requested PHC for adjournment of the hearing as the previous lawyer had become a government lawyer and he has submitted new power of attorney.

NAB prosecutor Hashmat Jehangir argued that the petition had become ineffective as no new notice had been issued after the previous. Justice Ijaz Anwar asked what kind of inquiry this was, and the NAB prosecutor explained that the Chief Minister was accused of misusing his authority when he was the Federal Minister for Kashmir Affairs. PHC’s divisional bench comprised Justice Ijaz Anwar and Justice Shakeel Ahmad adjourned further hearing by granting time to the Chief Minister’s lawyer for preparation to argue the case.

Meanwhile, PHC’s divisional bench comprised of Justice SM Attique Shah and Justice Syed Arshad Ali disposed Pakistan Tehreek-e-Insaf (PTI) social media In-charge Azhar Mashwani wife and brother pleas against enlisting their names in the Exit Control List (ECL) and the Provisional National Identification List (PNIL).

The counsel Syed Sikandar Hayat Shah and Ali Azim Afridi advocates argued that the petitioners enlisted in ECL and PNIL, which prevented them from traveling abroad. Additional Director Legal of the Federal Investigation Agency (FIA) Abdul Rehman informed PHC that the petitioners’ names had been removed from the list. However, the lawyer Ali Azim argued that Azhar Mashwani wife was off-loaded from airplane.

Justice S M Attique Shah asked why the petitioner being stopped from going aboard, however, Additional Director Legal replied that it was possible that their names were still on the list at the time of her travel. The court expressed surprise at how this could happen, and the FIA representative assured the court that the petitioners’ names had been removed from the list. PHC’s divisional bench comprising of Justice SM Attique Shah and Justice Arshad Ali disposed of the petition, accepting the FIA’s assurance that the names had been removed from the list.
