PHC orders police for provision of record

PESHAWAR: Chief Justice Peshawar High Court (PHC) Justice Muhammad Ibrahim Khan ordered police for submission of reply in illegal custody of father along with son and receiving Rs4 lac from their family as well as stopped from harassing female petitioner, on Thursday.

The petitioner informed PHC that police raided her residence on 18th June 2023 and arrested her husband along with son who is student. She added that police also took Rs4 lac along with documents, gold, mobile phones and passport into their possession during the raid.

Police took her husband and son during the raid into their custody without any allegation and shifted to Khanmai police station, Charsadda district, the applicant pleaded. She argued that police also took into possession documents of her son named Awais who is a student and applied for scholarship.

The police demanded Rs4 lac for release of her son during visiting Khanmai police station, Charsadda district, the petitioner added. She added that police had tortured her husband and son during custody as well as charged her husband in fraudulent case.

The applicant argued that police is threatening her for provision of money otherwise they {Khanmai police, Charsadda} will kill her son and will throw dead body into Kabul’s river. She provided Rs4 lac to police to secure her son’s life, the petitioner added.

As well as her husband obtained bail from High Court after charging in baseless case by, she added. The claimant argued that she had knocked the doors of Human Rights, police and other Law Enforcement Agencies for actions against involved policemen but to no veil. The petitioner argued for provision of justice as well as actions against policemen involved in illegal custody of her husband and son.

Meanwhile, Superintendent of Police (SP) Operation and Deputy Superintendent of Police (DSP) Sar Dheri Sanobeer along with other concerned policemen appeared on directions of PHC after the break.

However, police informed that the petitioner’s husband is member of dacoit gang as well as two Afghan citizens are also active their group. They added that the petitioner’s husband is also charged in another dacoit offense earlier. The Chief Justice Muhammad Ibrahim Khan inquired regarding arrest of petitioner’s husband earlier in any other offense, while, police requested for provision of time to produce record before court. Chief Justice PHC Justice Muhammad Ibrahim Khan stopped police from harassing the petitioner and adjourned further hearing till 24th January.
