Speaker ordered to administer oath to Kumar as MPA

PESHAWAR: A division bench of Peshawar High Court (PHC) Thursday directed the speaker Pakhtunkhwa Assembly Asad Qaiser to administer oath to Baldev Kumar as minority member of the provincial Assembly.

Baldev Kumar is in jail over charges of involvement in assassination of PTI minority MPA and adviser to chief minister, Sardar Soran Singh in Buner.

Baldev Kumar was second of the priority list of the PTI for minority MPA. After assassination of the Soran Singh, the Election Commission of Pakistan notified Baldev Kumar as returning candidate in August 2016.

However, the speaker Khyber Pakhtunkhwa refused to invite him for taking oath as he was accused of killing the PTI MPA.

Baldev Kumar had moved the Peshawar high court against the speaker provincial assembly for not inviting him for oath. The bench The counsel for Kumar said that the speaker has deprived his client from becoming member of the provincial assembly. He said that the speaker has power to issue production orders for him to take oath. However, he added, the speaker was not issuing production orders for taking oath from his client.

The high court bench comprising of Justice Ikramaullah Khan and Justice Mohammad Ghazafar directed the Speaker to take oath from Kumar as provincial assembly member and disposed of the petition of Kumar.
