Writ petition file against issuance of tax notices

PESHAWAR: A writ petition has been filed against the issuance of Sale Tax and Service Tax notices to only children park in the provincial metropolis named Chahcha Younas Family Park at Peshawar High Court (PHC) by Khyber Pakhtunkhwa Revenue Authority.

The writ stated that KPRA has issued sale tax and service tax notices to Chacha Younas Park which isn’t fair because the facility serves marginalized communities and most of children visit for enjoyment. Also, Chacha Younas Park is located in the densely populated area of Peshawar and there is no entertainment facility, so the facility can’t be liable for sale and service taxes, the petition argued.

The writ filed by Ishaq Ali Qazi Advocate on behalf of park’s administration stated that the facility is equipped with entertainment tools for children. Such taxes like sales and services weren’t received from Hayatabad with similar facilities. The writ pleaded that neither in Punjab and Sindh provinces nor in foreign countries such taxes are received as directed Chacha Younas park for submission.

The petition added that taxes wouldn’t be received from children-related facilities because minor goes for enjoyment and adults for entertainment under KPRA laws at entry 45. Chief Secretary Khyber Pakhtunkhwa and Director General KPRA have been made respondents in the writ petition while requesting to declare the notices null and void.
