Chief Justice orders DPO Kohat to appear in-person before PHC

PESHAWAR: Chief Justice Peshawar High Court (PHC) Justice Muhammad Ibrahim Khan ordered once again District Police Officer (DPO) Kohat for in-person appearance for arrest of Local Government Kohat chairman Nabi Ullah from court’s premises, on Wednesday.

PHC Chief Justice Muhammad Ibrahim Khan observed that how a person is arrested from the court’s premises despite he had surrendered before the court. The concerned officials may face Contempt of Court proceedings if deems necessary, Chief Justice remarked.

The counsel Khurram Zeeshan advocate argued that Pakistan Tehreek-e-Insaf (PTI) village council Kohat chairman Nabi Ullah was arrested by police on 19th January from court’s premises and added that his whereabouts are still unknown.

The counsel further added that no one is aware about him after 12 days of his arrest despite the petitioner had obtained bails in three different cases. In the meantime, Station House Officer Cant Police Station Islam-u-Din denied custody of Nabi Ullah, however, Assistant Advocate General requested for provision of time for submission of report in this regard.

It is a fundamental question that how can a citizen is arrested from premises of court? Chief Justice observed and added that concerned officials may dace Contempt of Court proceedings in this regard while ordered DPO Kohat for appearance in-person on next hearing.

AD&SJ convicts’ murderer to death penalty: Additional District and Session Judge (AD&SJ) Iftikhar Elahi convicted murderer for death penalty along with Rs5 lac fine in famous Kalu Khan murder case. The counsel for complainant Syed Mubashir Shah argued that accused Farooq Ahmad had killed Abdullah resident of Sheikh Jana in June 2022 over oral dispute.

The complainant filed First Information Report against Farooq Ahmad at Kalu Khan police station Swabi and the culprit was produced before competent after his arrest. The prosecution had submitted several evidences and witnesses which is enough for provision of maximum punishment to the murderer, Mubashir Shah advocate argued. However, the counsel for petitioner argued that evidences and witnesses are self-contradictory and requested for acquittal. AD&SJ Iftikhar Elahi convicted the murderer for death penalty after conclusion of arguments.
