Delimitation of constituencies, probable delay in elections

PESHAWAR: A writ has been filed at Peshawar High Court (PHC) challenging Election Commission of Pakistan (ECP) notification regarding delimitation of constituencies which will cause delay in holding general election within 90 days as stated in the press statement.

The writ petition is filed by Naeem Ahmad Khattak Advocate stating that on 17th August 2023 ECP has issued notification arguing that the constitution of constituencies is continued which will be completed in December 2023. ECP notification further stated that due to delimitation holding of General Election within 90 can’t be possible, the writ petition stated.

The petition argued that holding election within 90 days after the dissolution of assembly is a constitutional responsibility of ECP. The Chief Election Commissioner, ECP’s members and Secretary of Supreme Judicial Council have been made respondents in the writ petition. The writ argued that ECP notification is unconstitutional and illegal as well as contradictory with Supreme Court of Pakistan’s decisions. Supreme Court has declared that holding election within 90 days is constitutional responsibility and several factors are involved in sabotaging the constitutional process while argued for declaring ECP’s notification null and void, the writ petition stated.

PHC grants interim bail to Anwar Zeb: PHC’s Justice Syed Arshad Ali has granted interim bail to Pakistan Tehreek-e-Insaf former provincial minister Anwar Zeb in case for violation of section 144 of Criminal Procedure Code (CrPC) and ordered to appear before competent court on 4th September.

The counsel Muhammad Adil advocate argued that former minister participated in a rally regarding Independence Day celebration while charged for violation Section 144 imposed in the premises. Additional Advocate Danyal Chamkani objected to the bail plea and argued that the petitioner should approach Session Court Bajaur for relief while PHC has ordered Anwar Zeb to appear before competent court on 4th September and dispose-off the petition.
