PHC adjourns hearing in Shama Cinema writ petition

PESHAWAR: A two-member bench of the Peshawar High Court (PHC) comprising Justice Rohul Amin and Justice Syed Arshad Ali has adjourned the hearing of writ petition filed for the construction of a multi-story building on the site of famous Shama Cinema Building in Peshawar, on Tuesday.
During the hearing the counsel Qazi Jawad Ihsan Ullah informed court that petitioner obtained lease while its renewal procedure is conducting every 30 years in routine.
The counsel argued that petitioner aims to construct a multi-story building in accordance with law under commercial lease policy.
The counsel informed that in commercial lease there is no need for obtaining another lease but military state office and cantonment board officials are not allowing the construction of a plaza in this regard. Applicants face severe mental retardation.
The counsel Qazi Jawad Ihsan Ullah informed the court that the matter had also been referred to the Attorney General office which had stated that since there was already a lease of commercial land.
The counsel informed that NOC is not being issued and construction of commercial plaza is not being allowed by competent authorities.
The counsel informed that case is delayed due to busy schedule of Military Estate Office and Cantonment Board’s lawyers while PHC has adjourned hearing.
