PHC hears contempt plea against ANP’s Aimal Wali

PESHAWAR: Chief Justice Peshawar High Court (PHC) Justice Muhammad Ibrahim Khan observed that Contempt of Court proceedings would be dispose of when Awami National Party (ANP) Khyber Pakhtunkhwa President Aimal Wali admitted before media that he does not threatened judiciary as well as acceptance of harsh rhetoric, on Thursday.

It is worthy to mention that hundreds of ANP lawyers and activists were present in the Court-No:1, however, Chief Justice ordered evacuation of the court for the proceedings.

Chief Justice PHC Justice Muhammad Ibrahim Khan remarked that Aimal Wali rhetoric not only an attempt of his character assassination but also threatened the judiciary which isn’t acceptable in civilized society. He added that it is neither his personal issue but it had created insecurity for judges and their families.

I will to forwarded the case to Anti-Terrorism Court if I wanted, because it has threatened judges but the Contempt of Court plea is submitted against a person whose family had granted great sacrifices for the nation, Chief Justice observed. Chief Justice remarked personally he doesn’t mind it but ANP president must have to explain his position in this regard.

The Chief Justice observed these remarks during Contempt of Court plea against ANP provincial president Aimal Wali for threatening and character assassination CJ PHC filed by Pakistan Tehreek Insaf leader Fazal Muhammad Khan while Barrister Sarwar Muzaffar Shah appeared before court on behalf of the petitioner.

Advocate General Amir Javed and Additional Advocate General Danyal Asad Chamkani were present for court’s assistance while Barrister Emir Ullah Chamkani, Ahmad Farooq Khattak and Babar Khan Yousafzai advocates represented Aimal Wali before court.

Chief Justice observed that where is Aimal Wali? ANP president reached the Rostrum and argued that Aimal Wali is present on court’s order while apologized for his harsh words as well as denied the threatening of judges or judiciary.

In the meantime, Chief Justice observed that as Pakhtun we can know how to react to the threats if Aimal Wali had given threats but his position {Judge/ Chief Justice} demands tolerance and patience. Chief Justice Ibrahim Khan remarked that he has served in judiciary for 32 years and added that I will call Aimal Wali as son because his sons are in similar age period.

Justice Muhammad Ibrahim Khan ordered to play video clip in which Aimal Wali threatened judiciary and objected Chief Justice PHC. However, ANP’s lawyers argued that the interview is speculated for political goals because the petitioner is opponent of Aimal Wali in upcoming general election and requested for provision of soft corner in this regard {acceptance of apology}.

Advocate General Khyber Pakhtunkhwa Amir Javed argued that respect of judiciary is obligation of every political party, however, Aimal Wali said that he is present before the court for dignity of the judiciary. ANP president argued that he can never think about contempt of court or threatening judiciary but had made an innocence complain in this regard. Aimal Wali added that he may used harsh word, however, Barrister Amir Ullah requested for court’s mercy in this regard.

Chief Justice PHC Justice Muhammad Ibrahim Khan observed that COC would be dispose-off after acceptance of usage of harsh rhetoric before media and adjourned further hearing after arguments.
