Damaging confiscated vehicle itself crime: CJ PHC observed

PESHAWAR: Chief Justice Peshawar High Court Justice Qaiser Rashid remarked that why should not court direct inspector General of Police Khyber Pakhtunkhwa to take disciplinary action against personnel involved in take away spare parts from vehicle confiscated in cases, on Thursday.

The Chief Justice observed such remarks during hearing of petition filed by Amir Raza seeking recovery of his motorcycle which confiscated in drug case while the petitioner had already registered First Information Report for lifting of bike before the confiscation in offense.

The counsel informed PHC that when petitioner reached the police station to obtain his motorcycle, it is revealed that spare parts were removed from bike while it is able to drive.

During hearing Chief Justice Qaiser Rashid remarked that removing spare parts and damaging confiscated vehicle in itself as a crime and added that why not personnel involved in the offense shall not dismiss from service. Chief Justice also remarked that such personnel are defaming institutions.

Additional Advocate General Syed Sikandar Shah and In-charge Tauheedabad Chowki appeared before court and informed that the petitioner’s motorcycle has been restored.

PHC has disposed-off the petition with above remarks and observed that if such complaint is reported in future then court will direct IGP to take stern actions.
