Devolution of powers to LG members: PHC directs to complete in 10 Days

PESHAWAR: A divisional bench of Peshawar High Court comprising of Justice Musrt Hilali and Justice Attique Shah directed to devolved power to newly elected Local Government office-holders within 10 days during 1st phase of elections, on Thursday.

The counsel for petitioner Babar Khan Yousafzai and Additional Advocate General Rab Nawaz Khan appeared before court.

The writ argued that on 19 December 2021 election was conducted 17 districts of Khyber Pakhtunkhwa during 1st phase of LG elections while powers did not devolved to newly elected public-office-holders. The petition further added that in accordance with LG Act 2019 under section 79(1) the powers shall be delegate within 15 days of notification issued of winning candidates while session should also be called in timeframe.

The writ petition further argued that under sections 78(1) and 80(1) of LG Act 2019 should take oath before joining office and added that residents of 17 districts are impacting due to failure in implementation of the Act. The divisional has directed competent authorities to entrust powers to LG members and complete the process in 10 days while disposed-off the instant writ petition.
