IGP to appear before court in case of police failure: PHC

PESHAWAR: A divisional bench comprising of Chief Justice Peshawar High Court (PHC) Justice Muhammad Ibrahim Khan and Justice Ishtiaq Ibrahim observed that Inspector General of Police (IGP) Khyber Pakhtunkhwa to call before court in failure of District Police Officer Swabi to recover minor till 19th December, on Tuesday.

Additional Advocate General Danyal Asad Chamkani, Federal Investigation Agency Legal Officer Abdur Rehman Afridi and Station House Officer Kalu Khan police station Ajab Khan appeared before PHC during the hearing.

The counsel Sana Majeed and Imran advocates argued that Maryam Taj had married with Abid Iqbal resident of Swabi in 2017 and have a baby boy named Adam Iqbal aged 4 years. They added that 25 days ago Abid Iqbal had snatched Adam Iqbal from his mother Maryam Taj and shifted to Swabi.

The counsel argued that on previous hearing PHC ordered SHO Kalu Khan for recovery of minor but to no veil. However, SHO Kalu Khan Ajab Khan informed that several raids are conducted along with bailiff for recovery of Adam Iqbal but it was unsuccessful attempts.

In the meantime, the petitioner counsel argued that police isn’t interested in recovery of minor because Abid Iqbal had married for second time 3 days ago in Swabi and its evidences are available.

FIA Additional Director Legal Andur Rehman Afridi informed that names of Abid Iqbal and his son Adam Iqbal are placed in stop as they can’t able to go aboard.
Chief Justice PHC Justice Muhammad Ibrahim Khan observed that it is serious issues as a mother had approached court for recovery of her minor child. He remarked that IGP Khyber Pakhtunkhwa may be called for appearance before court in case of failure of concerned police.

PHC also directed National Database and Registration Authority for blocking Computerized National Identity Card of Abid Iqbal immediately. However, the counsel argued that the marriage is still intact but Abid Iqbal snatched his son force and didn’t allowing petitioner to meet with minor.

PHC’s divisional bench comprising of Chief Justice Muhammad Ibrahim Khan and Justice Ishtiaq Ibrahim adjourned further hearing till 19th December while directed DPO Swabi for recovery of minor otherwise IGP will appear before court.
